A man is facing sexual battery charges, after he's accused of having sex with a woman who passed out from drinking.
Lee County deputies say the victim was picked up from a bar Monday, after a night of drinking.
They say her mom took her home and made sure she went directly to bed.
The victim told deputies, she woke up around 3:00 a.m. Tuesday to Carlos Cervantes on top of her having sex with her.
She pushed him off and later went to a rape crisis center.
Cervantes is in the Lee County jail on a $125,000.00 bond.
