Polsenberg family lawyer determining 'next moves' after federal charges dismissed

FORT MYERS, Fla. — Laywers for the family of Zach Polsenberg have 14 days to determine their next steps in their lawsuit against Lee County Schools, Riverdale High School and Lee County EMS.

This comes after a federal judge recently dismissed some charges in the case.

Zach was a football player at Riverdale High School who died after practice in 2017.

His family is suing the school district, the high school and county EMS for negligence, among other things.

The family's lawyer, Ty Roland, says they will now have to decide whether they want to submit new federal charges or move the case to a lower court.

But he is confident that the case will move forward.

"At this point the only question is where is it going to continue, where is our fight going to continue, not if," said Roland.

Lee county schools has declined to comment on the case.
