The incident happened back in November 2018 in the parking lot of a McDonald's.
Deputies say Smith was driving the wrong way when he pulled into McDonald's and then showed a woman an AK-47.
Deputies say Smith pointed his gun at them and refused to obey their commands.
They fired a bean bag gun at him which didn't work.
When deputies saw Smith cock his rifle, they fired four times.
