Construction barrel causes $1,600 in damages to man's car

CAPE CORAL, Fla. -- Fox 4 is in your corner searching for answers on who is liable if construction equipment ever damages your car.

One Cape Coral man having to pay out of pocket after colliding into one of those orange construction barriers in the middle of Burnt Store Road South in Cape Coral .

“I swerved to avoid it, catching the curb on the left and barrel on the right,” said Julian Long, Cape Coral.

Julian Long tells Fox 4 he and his wife were driving south on Burnt Store Road toward Pine Island Road on a dark rainy night of June 13th.

“We hit, it went flying ya know, what the heck,” said Long.

Long calling Cape Coral Police Department to come out to report striking the barrel that was in the street, causing damage to their car.

“The next day I could see clearly the black rubber that they fix to the ground it wasn’t on it,” said Long.

A collision company estimating the total cost of repairs about $1700.

“There’s a liability factor and a negligence factor because the base was not secured for the storm,” said Long.

Long says he reached out to both the City of Cape Coral and Lee County trying to get answers on who’s responsible. After a month of phone calls the construction company’s insurance telling him, “it doesn’t look like this would be something we are liable for.”

The insurance representative also tells Long the construction company isn’t at fault for anything that happens near a site during off hours.

Fox 4 reached out to both the city and county as well. Both are looking into the incident Long reported and will provide answers next week.

Lee County advising if an incident like this occurs report it right away.
