LEE COUNTY, Fla. — Casey Crowther's motion to dismiss his case has been denied.

Crowther received more than two million dollars through the PPP loan on behalf of his company Target Roofing & Sheet Metal Inc.

He was arrested in September allegedly misusing the funds and faced additional charges in October.

Court records show Crowther filed a motion to have the case dismissed.

“The Indictment Should Be Dismissed in its Entirety Because the Government has Misinterpreted the CARES Act and its Governing Regulations and Crowther’s Arrest was Premature.”

New records show the courts have denied Crowther’s motion to dismiss.

Crowther is set to have a status conference on January 11th and a court only jury trial on February 1st.
