LEE COUNTY, Fla. -- Wednesday the retirement officially takes place for the Fort Myers Police Captain charged with fraud and prostitution.

The Florida Department of Law Enforcement arrested Captain Jay Rodriguez last week. They say he engaged in a sex act with a prostitute while he was working undercover in 2013.

Rodriguez wrote a letter telling the chief he wanted to retire.

If he's convicted of the crimes, he will lose the city's contribution to his pension. But if he's cleared, he will be able to keep it.
