Accused Cape Coral foster child abuser in court in Alabama

A Cape Coral father accused of heinous abuse of his ten foster and adopted children has been moved out of the Lee County Jail and is in Alabama awaiting trial. He appeared in court Monday afternoon.

Daniel Spurgeon was arrested in 2016 in Cape Coral, along with his wife Jenise Spurgeon, after their 16-year-old and two 13-year-old foster daughters were found drunk at a KFC restaurant. The girls told police Daniel Spurgeon had given them alcohol. Investigators determined the abuse started when the family lived in Florence, Alabama. The couple also has two biological kids in addition to their foster children. 

Daniel Spurgeon is facing 76 charges in Alabama, including aggravated child abuse, human trafficking, sex abuse with a child under 12, first-degree rape, sodomy, and sexual torture.

Daniel Spurgeon's 55-page indictment includes notes from interviews with five of the foster children. It says all five kids disclosed some form of abuse by Daniel and Jenise Spurgeon, or the other children in the home who were juveniles at the time. 

One foster daughter, said in an interview with investigators that when she was 12, she got into a fight with Jenise -- her foster mom -- who made her stay home with Daniel while she took the other kids to swim practice.

"Every day while they were at swimming and they were gone for 2 to 3 hours, I would be in the basement with him alone," she said to the investigator. "I would stand in the middle of the basement blindfolded." 

She said she was naked and Daniel Spurgeon would hit her with "all kinds of stuff."

She told investigators the abuse happened almost every day while Jenise was gone.

She told detectives once they moved to Cape Coral, she found out Daniel was also abusing her two little sisters.

One of them told her that she told Jenise three times Daniel was touching her inappropriately, and Jenise didn't believe her.

The couple is charged with human trafficking because they were getting money for being foster parents to many of those kids.

Daniel Spurgeon is being held on a $251,000 bond in Alabama. His next hearing in Lee County is set for September 18th. 

Jenise Spurgeon is due in court on July 28th in Alabama. She was extradited to Alabama last year but is out on bond living in Florida.
