Four In Your Corner has been digging deeper into the disturbing allegations at Cape Coral Hospital. Jeovanni Hechavarria, a former nurse isn't facing criminal charges and is still legally allowed to work with patients, despite being accused of raping one of them.

Since the hospital attack in July 2016, Lee Health has fired Hechavarria and the Florida Department of Health has placed an emergency active restriction on his nursing license. According to FDOH, Hechavarria is prohibited from practicing in any capacity as a nurse with female patients without a Department-licensed healthcare provider present at all times.

Documents show Hechavarria threatened the 43 year old patient not to tell anyone because he knew where she lived and he would be back to repeat his actions later that night.

The allegations has left people wondering why the former Cape Coral Hospital Nurse who allegedly raped a patient is not behind bars six months after the victim says it happened.

"It's scary," Diane Pozzie, a Cape Coral resident said. "It would make me think twice about where I go and the people that come in my room. I see people for lesser crimes that are arrested immediately and brought to justice. Something like this should not have happened."

Another concern in question is why it's taking so long to make an arrest. Four In Your Corner sat down with Walter Zalisko, a private investigator and retired police chief.

"They want to make sure they have all their 'i's dotted and 't's crossed," Zalisko said.

The Florida Department of Law Enforcement confirmed they have received three evidence submissions for this case. One piece of evidence us still being processed, causing the delay, which they say is not uncommon to make sure they get it right.

"It's totally unacceptable to have six or seven months and not have any results back," Zalisko said.
