Murdered man's son may be released

CAPE CORAL, Fla. -- Attorneys for a Cape Coral man accused of using his missing father's credit card are filing a motion to have him released on house arrest.

Matthew Marshall has been behind bars for two weeks after he was busted for using his father's credit card just one day after his dad, James Marshall, disappeared.

According to sources close to the case, the body of his father, James "Rick" Marshall, was found dismembered near the Island Cove condos where he lived, days after a business associate reported him missing.

Matthew, who has not been named as a suspect in his father's death, is due back in court next Wednesday.
