Mark Sievers in court Friday at DCF hearing

FORT MYERS, Fla. -  Mark Sievers appeared in court Friday at an Emergency Shelter hearing for his two daughters.

An Emergency Shelter hearing is held within 24 hours after the Department of Children and Families have removed a child or children from a caregiver.

During the hearing DCF officials said that after reading the documents from the State Attorney's Office, they are concerned for the safety of the children and are worried the kids are in impending danger if Mark is arrested.

Sievers attorney argues talk of an arrest is just speculation.

The judge pointing out the kids can't be removed based on speculation, and ultimately asked for the hearing to be continued to Monday.

DCF officials say they have a plan in place if Mark goes to jail, but did not elaborate, only explaining Mark's plans for the kids were not approved, "one of the individuals he has chosen, we've kind of gone back and forth and we did a home study on them and it was denied." Denied because that person had a verified sex abuse report with DCF from 2009.

The judge will determine at Monday's hearing if probable cause exists to remove the children from Sievers or to keep the children under shelter status pending further investigation of the case.

 

 

Dr. Teresa Sievers was found dead in their home on June 29th, bludgeoned to death with a hammer, according to recent reports.

This week, pages of search warrants and affidavits, including records of cell phone traffic, lead investigators believe Mark Sievers hired Curtis Wayne Wright to murder his wife for life insurance money. Her policies totaled nearly $4.5 million.

Earlier this week, Lee County Sheriff Mike Scott appeared on Nancy Grace's show on HLN to discuss the case, saying that they believe Mark was involved and they're working to prove it.  "Sievers' husband is in an envelope of suspicion.  I've referred to it as an envelope of suspicion."

Curtis Wayne Wright, a longtime friend of Mark Sievers, has been charged with 2nd Degree Murder in Teresa's death.  Jimmy Rodgers is also wanted in the case, and is currently serving a 6-month term in federal prison for violation of probation.
