Woman presses charges when partner's security camera records couple having sex

LEE COUNTY, Fla. - An unsuspecting woman was shocked to learn a security camera captured intimate moments she thought would stay private.

A Lee County woman visited her friend's home earlier this week. The two began kissing in the living room and then had consensual sex.

According to the deputies, the woman noticed a camera that pointed at the couch. She asked her friend about it and he confirmed it was in fact a camera.

She later found out that the camera recorded them during intercourse because it was a motion sensor camera.

The woman told deputies she never gave him permission to record her.

Scot Goldberg is an attorney downtown and not involved in this case. He said the unnamed woman has a right to be upset.  "I believe anytime you get intimate, you have an expectation of privacy," Goldberg said.

Andrew Jennings works at uBreakiFix in Cape Coral. He is an advocate of security cameras, but thinks you are obligated to inform guests in cases like this one.  "It is good etiquette to tell them everything is being recorded for security purposes," Jennings said.

Goldberg said that technology hasn't necessarily increased the number of litigations he's seen. However, he has seen a different type of spike.  "There's an increase in the level of uncomfortable positions people get put in because you don't start really paying attention until it happens to you," Goldberg said.
