BONITA SPRINGS, Fla. — Marc DeTomaso was convicted of putting his hands inside a woman's underwear, and performing oral sex on her during a massage in 2017. He was charged originally with sexual battery, but he was convicted of a lesser charge, misdemeanor battery on Wednesday.
A woman came in for her regular appointment at Massage Luxe Spa on Bonita Beach Way in 2017. She said she left sexually assaulted by her massage therapist, DeTomaso.
FOX 4 first told you about this when the crime happened. Since 20-14 the State of Florida has required massage therapists to pass a background check before they can get their license to practice.
DeTomaso was arrested in 2007 for drug possession in Collier County, and that charge did not disqualify him from becoming a therapist.
The Department of Health issued an emergency restriction on DeTomaso right after the alleged crime in 2017, preventing him from practicing unless a licensed therapist was present in the room.
Now he'll have to serve one year in Lee County Jail.
