Investigators determined that the victim had arrived at the home to walk the dogs of his girlfriend's parents, who are out of town. When he arrived at the home, he found his girlfriend's brother, 39-year-old Michael Capobianco, living in the home.

When the victim told Capobianco he needed to leave, since Capobianco had been kicked out of the home by the parents, Capobianco attacked the boyfriend, hitting him numerous times in the head and about his body with a closed fist. Capobianco then placed the victim in a choke hold and applied pressure to the point it caused the victim to loss consciousness. The victim was then kicked in the face and head several times.
