CAPE CORAL, Fla. — Cape Coral City Council will vote on a loud noise ordinance Monday. If excessive noises are heard within 50 feet of someone’s car and 100 feet from a home, owners could face a $150 fine.
Deontrae Baxter lives in Cape Coral and said if you pay for your property, you should be able to do what you want when you want.
“Why would you fine somebody for listening to music?” He asked. “It’s your property. You can play what you want, do what you want all sorts of stuff. But then again. You’ve got to keep it to a certain extent.”
Joseph King said that extent means drivers should keep it down when staying in one place.
“I could see if you’re driving down the road, you want to listen to your music, that’s great. But if you’re in a parking lot, and other people are around and you’ve got your tunes bumping, that’s annoying,” he said.
He added he has his kids to think about.
“I really don’t want them to hear “F” this and “F” that. Just be respectful,” he said.
People who violate the loud noise ordinance twice within one year will face a $500 fine. Something Baxter called excessive.
“I’d say it go up to $200 or $250. Not just throw in a ballpark $500 from $150,” he said.
The ordinance would require law enforcement to issue a warning first and give violators five minutes to lower the noise. It would apply to loud noises in homes between 11 p.m. and 7 a.m.
