$2M Bond issued for man charged with attempted murder of Sanibel officer

A Sanibel man accused of drive-by shooting ambush on an officer was issued a $2 million dollar bond. 
 
Jon Hay faces one count of first-degree attempted murder against a law enforcement officer. He showed very little emotion Monday as a judge issued his bond and a no-contact order with Jarred Ciccone, the officer he's accused of trying to murder. 
 
Hay's bond was much lower than the 8 million state prosecutors requested. Hay's defense attorney argued the lower bond is reasonable because of his clean criminal record. 
 
"He has been a Lee County resident for 11 years and he has no prior criminal history that should be a factor when making a determination on bond and I think the judge did take that into consideration," said Ryan Doyle, Defense attorney. 
 
Ciccone was sitting in his car after a routine traffic stop when he was shot. Investigators say he also engaged in a gun battle with two others officers when they attempted to arrest him. Fourteen spent shells were recovered from the scene and an AR-15 style rifle was also recovered, according to investigators. 
 
A criminal trial attorney not connected to the case told Fox 4 because this isn't a murder case Hay's non-violent past may have played a larger role in the Judge's decision. 
 
"Prior record is very important to a judge," said Stuart Pepper. "Also their ties to the community; has this person lived here for many years, were they born and raised here," he added. 
 
If Hay's does post bond he'll be required to wear a gps-monitor and turn over his guns to the Lee County Sheriff's Office. 
 
His case comes at a time when officers around the country are coming under target, and some argue a $2 million bond may not be high enough to fit the crime. 
 
 "The question is what's a fair amount under the constitution," said Pepper.
