Officer accused of DUI not yet charged, investigation still active

A Cape Coral police officer accused of crashing into a home while drunk has not yet been charged. 

Officer Emily Zyvoloski was off-duty and driving her personal vehicle when Cape police say she crashed into a home in the 400 block of Nicholas Parkway. 

Nearly two weeks after the incident, a Cape Coral spokesperson says the DUI investigation into the crash is still ongoing, and as a result no charges have been filed.

The 33 year-old's blood alcohol level was more than three times over the legal limit when tested at the hospital, according to the police report. 

Zyvoloski has been with the Cape Coral Police Department since 2007. Her personnel file was mostly filled with satisfactory reviews, despite a disciplinary action letter in 2015 for failing to report a business accused of selling marijuana. 

The letter states Zyvoloski left a review for the business online, warning people to stay away "in case they get raided." Cape Police later discovered Zyvoloski was aware of the illegal sale of marijuana taking place at the business, along with possible fraud. 

Zyvoloski is recovering from the injuries she sustained in the crash.
