Estate of man who fell off Fort Myers dinner cruise is suing

FORT MYERS, Fla. — The family of a man who fell overboard during a dinner cruise last December is suing a security company for negligence.

The Estate of Joel Henderson is suing John Fraioli, owner of Suncoast Security Company for negligence after Henderson died from falling off of a dinner cruise boat operating out of downtown Fort Myers on Dec. 4, 2020.

Legal documents say Henderson slipped on the stairs and fell overboard into the Caloosahatchee River. The boat's first Mate witnessed Henderson fall overboard having been on the same stairs.

Court papers say a haphazard search was organized using the staff and the employees of the security company. Henderson was not located until he was found dead in water a few days later.

The suit alleges that the defendant's employees were not trained to respond to man overboard incidents, nor were they equipped with sufficient tools to assist in the location of Henderson.
