The ex-husband of Cape Coral Mayor Marni Sawicki has retired from the city's fire department despite an ongoing investigation into an incident involving the pair.

The Cape Coral Fire Department confirms Lt. Ken Retzer retired in February, but said an investigation into his actions late last year continues.

Cape Coral police responded to Mayor Marni Sawicki's home November 1st for a domestic disturbance, but Sawicki and Retzer refused to cooperate.

According to a Cape Coral incident report, Retzer called 911 at 1 a.m. saying he smashed a phone and that he was leaving Sawicki's home.  When officers arrived, they found Sawicki at home upset.  They told her because it was a domestic disturbance, they had to get personal information from her.  According to the report, not only did she refuse to cooperate, she called the police chief.

After that conversation, she again refused to answer the officers' questions.  They even called Retzer back and he also refused to cooperate with the investigation.

This isn't the first time the couple has made headlines.  Sawicki filed a restraining order against Retzer in May saying she feared for her safety.  She even missed a council meeting over those fears.  But the two reconciled and married just months later, before getting divorced weeks after tying the knot.

The Cape Coral Fire Department has not provided any details about the nature of the investigation into Retzer's actions and will only say he has retired.  They gave no timetable on when the investigation would be complete.
