Arguments set in challenge to FL drug testing law
ATLANTA (AP) - A federal appeals court in Atlanta is set to hear arguments in a legal challenge to a Florida law requiring welfare applicants to pass a drug test.
The American Civil Liberties Union sued to challenge the law. A federal judge in Florida temporarily blocked the law last year pending the outcome of that legal challenge.
Florida has appealed the temporary block to the 11th U.S. Circuit Court of Appeals, which will hear arguments Thursday.
The ACLU argues the testing violates constitutional protection against unreasonable searches. Florida has argued that the law would save money and has said people who refused the test during the four months the law was in effect skipped it because they knew they would test positive.
The ultimate outcome could affect similar efforts in other states.
