CAPE CORAL, Fla. - The man accused of opening fire at a Cape Coral daycare and then murdering his wife, appear before a judge.  That led to fireworks in a Lee County courtroom.

Robert Dunn seemed convinced that his attorney's intention has been to sabotage his case. That his lawyer is trying to convince him to concede guilt even before his case goes to trial.

Robert Dunn sat before Judge Steinbeck shackled to his seat in a red jumpsuit. He laid out a case for why his attorney, David Brener, should be replaced- calling him condescending and disrespectful. But Brener claimed Dunn is mentally ill.

Brenner admitted advising Dunn to not take the stand during trial, saying they'd make minced meat out of you. Still judge Steinbeck came down with this decision.

“So if you do something to intentionally prevent Mr Brenner.... It's all my fault I understand. I get it. I'm just warning you because I don't want you to forfeit your right to court appointed counsel. Let me get out of here, let me just go. I need to hear this.” Robert Dunn says.

If Dunn is convicted of first degree murder, he’ll face the death penalty. His trial begins October 15.
