No charges filed in fatal wrong apartment shooting last year

LEE COUNTY, Fla. -- The man who shot and killed a stranger who accidentally walked into his apartment last year will not face any charges.

Last march, 32-year-old Ryan Modell wasshot around 2:30 a.m. when he apparently attempted to walk into the wrong apartment at Emerson Square in Estero while intoxicated.

The man who killed him, Jason Taylor, will not face charges.

Taylor admits shooting Modell in the chest, but told investigators that Modell refused to leave the property and the he was defending himself.

He says Modell woke Taylor and his wife up by banging on the front door.  Taylor told Modell to leave and slammed the door shut, injuring Modell's toe.  Taylor says he went to retrieve his firearm and when he went outside, Modell sprayed him with water from a hose.

Modell then reportedly began yelling at Taylor and charged towards him before the sooting occurred.

The State's Attorney Office ruled he had a right to defend his property, citing the “Stand Your Ground” law in this case.
