An attorney for one of the defendants in the Lake Boyz gang delivered subpoena to city officials Wednesday night.

Ft. Myers Mayor Randy Henderson and City Manager Saeed Kazemi confirmed they received a 2 page document related to the case.

Last month several members of the gang were arrested and charged under a federal racketeering act.  Sawyer Smith, attorney for one of the defendants says those charges should be dropped since the city denied there was an issue with gangs.

A scathing audit of the Ft. Myers police department concluded officials downplayed the gang issue.

"This is a law enforcement question, I have no idea on how to testify on something of that nature," said Mayor Henderson.

Chief Derrick Diggs, Former Chief Doug Baker and the entire city council were also named in the subpoena.
