Cape officers cleared in deadly shooting

CAPE CORAL, Fla. - Two Cape Coral police officers have been cleared in the June 24th deadly shooting of Mark Alan Chernin.

The shooting happened in the early morning hours in the 2200 block of SE 15th Street.  Officers Andrew Miller and Matthew Mills were among several officers who responded to the report of an armed man walking down the street.

Chernin had fired shots and was walking with a rifle.  Not only was he carrying the rifle he had a  had a .40 caliber pistol in his waistband and a .45 caliber pistol on a leg holster.

Officers Miller and Mills ordered Chernin to drop the guns but he refused raising the rifle in their direction.

Miller and Mills opened fire killing Chernin.

As is standard, an investigation into the shooting ensued. The State Attorney’s Office concluded that the shooting was justified.

A subsequent internal investigation by the Cape Coral Police Professional Standards Bureau concluded that the shooting was within policy. Officers Miller and Mills have returned to full duty.
